Trump invalidates the US Census Empty Trump invalidates the US Census

In a move to get around the US Supreme Court's order that citizenship not be asked in the 2020 census, President Trump has issued an Executive Order that all agencies provide all data in their possession that indicates the citizenship of of very person in the US. His plan is to incorporate that data in the Census.

Unfortunately, this raises the question of whether the Census, unless derived from an actual enumeration, is even valid. Article 1, Section 2 of the Constitution holds that the census shall be "by adding to the whole number of free persons" the count of Slaves.

Thus, a count of the number of people is required, including citizens. You cannot, on one item, simply divert and say we’ll substitute a tally of chickens from the Department of Agriculture.

On numerous occasions, the courts have said the Constitution gives Congress the authority to collect statistics in the census, but they are intended to augment the Census. They are not the actual Census itself.

Thus, the question is, if the administration tries to pass off the data mining of departmental records as the actual enumeration of the census, is it legal? I think not. If you accept data from non-queried sources, it cannot serve as the surrogate to the information gained from an actual count. The Census must exclude such data.

The statistics contemplated by the courts, is based upon the actual count, not alternative sources. If alternative sources were valid, we might simply count Facebook or twitter, or any compilation of data from the departments, without regard for veracity. The whole concept of an independent count is not to guess, or depend on sketchy records, but to have an independent count made for that exact purpose. It is not a Census, and cannot be used to determine taxes, representation and other details about the US population.

Are you reframing the issue to be prophecy?

I know...let's change it again to be a fairy tale.  We'll have Trump, in a pink tutu, with a magic wand going around and tapping taxes, trade, Kim Jung Un--and a special kiss on the left cheek of Putin's ass.  We can have a yellow brick road, and call it infrastructure renovation.

Lots of silver confetti raining down as the Trump fairy taps the private parts of little girls (or boys...hummm).  He can recruit Jeffry Epstein and dub him Munchkin Jeff.

Razz
