A judge has criticised the Crown Prosecution Service after 'flimsy' allegations a 67-year-old teacher assaulted a pupil were were thrown out of court. Teacher Jean McCormick was accused by an 'irrational and over-protective parent' of grabbing a disruptive pupil's arm, District Judge Nicholas Sanders said. Judicial officers heard the youngster's mother contacted police and Ofsted after the child returned home from Overleigh St Mary's Primary School in Handbridge, Chester, with a bruise.

Mrs McCormick, who had been a teacher at the school for 38 years and had no prior complaints made against her, was charged with assault and appeared before Chester Magistrates' Court yesterday.

The case against the PE teacher was thrown out following a trial due to the 'flimsiest of evidence' presented by the CPS.

Delivering his verdict, District Judge Nicholas Sanders said the CPS's case had fallen a 'very, very long way short' of securing a conviction.
