Kentucky Republicans kill bill to limit child marriage because parents should have right to marry off kids

Post by Guest on Fri Mar 02, 2018 4:02 pm

A bill that would limit child marriage has run into opposition from Kentucky Republicans who argue that parents should be able to marry off their kids without interference of a court, the Courier-Journal reports.

The modest bill would not totally ban child marriages, but would require a judge to review records to make sure that the child was not the victim of abuse, that there are not domestic violence incident involving either party and that the adult is not a registered sex-offender. The bill would require that the judge deny the right to marry if there was a pregnancy that resulted from the adult spouse molesting the child.

This bothered Kentucky Republicans, including state Sen. John Schickel of Boone County, which includes suburbs of Cincinnati.

“I had some problems with the bill,” he said. “Decisions involving a minor child should be made by a parent, not the court.”

Kentucky has the third-highest rate of child marriages in the nation, according to the Tahirir Women’s Justice Center.

There is no federal law in terms of marriage, except that you can't ban folks of the same gender or different races from getting married.

The tenth amendment makes it quite clear who decided who else gets married.

Kentucky: If you are 16 or 17 years old, you must have the consent of your parents or legal guardian. Custody papers are required if your parents are divorced. The form that you need to have completed is the Consent to Marriage Form (84-FCC-501). It has to be witnessed by two witnesses who are at least 18 years old, signed by your parent or legal guardian, and sworn by the deputy clerk. If you are a pregnant minor you may apply to a district court judge for permission to marry without parental consent. If you are under 16, you must get approval to marry from the District Court. Minors cannot get married in Kentucky if parents or guardians are not residents of Kentucky.

They are both 16 with parental consent, 18 without.

I already knew that, but thanks for the answer.

The under 16 part?

Really?

"No one under the age of 16 may be issued
a license unless they are pregnant and have a District Court
Judge issue a court order directing the Clerk to do so."

OK, there is a small difference. Pregnant girls can get married if a Judge approves it.

This new law doesn't really change much. It still allows for 16-18 year olds to get married, it just allows them to do it, without the approval of their parents.

The way this article was written, it was like the new law was going to allow for 10 year olds to get married.

So there is a huge difference, one that contravenes British law.

The new law is based on stopping this problem marrying under 16 and also allowing children to be adults when over 16

Surely the former part is important

Frankly, if people want to get married at 16, they do not need their parents permission, but the state?

I mean what has the parents got to do with that?

Many parents already deny who their children can be in love with, to the extreme, some are forced into marriage by parents and even worse murdered, when they refuse?

It also means British law should change on parental conscent with 16 years olds to marry

This hindarance is how people are able to force young couples to marry with arranged marriages by their parents and families

No  person should be able to marry under 16 to some 40 year old perv, yet Kentucky law allows that

Yeah, maybe a judge tell the kids to wait until they are 17. Maybe forcing them to wait a year is good for them. I don't know how much smarter a 17 year old is than a 16 year old. I guess a little and maybe enough to not do something as dumb. I think this law is sorta like the laws that tell some Mormans they can't have two wives. legally they don't , but for all practical purposes, they do any way.

The US military has a similar law rule. You have to be 18 to sign up, unless your parents co-sign. Then you only have to be 17.

In the UK, you do not have to be 18 to joind the military.
You do to enter combat

This is not combat, so no idea how you are comparing love to the armed forces?

As to your other points, its interesting and understand your points, but its still a big no, no, to allow people under 16 to be forced to marry some warped perv, that sadly happens to many young Muslim girls around the world and in the US, many young Christian girls.

Hence we need to protect them from such predators and their parents that allow this

You have to be pregnant if you want to get married under 16, so in sense, the perv has already gotten ahold of the girl.

I don't know about Kentucky, but if someone knocks up a girl under 16 in Texas, they better be two or less years older, or they have committed a crime.

Therefore, a 40 year old that knocks up a 15 year old, in an attempt to marry her before she is 16 or maybe 18, isn't going to be allowed to marry her in most places in the US.

So we are down to 40 year olds, marrying 16 or 17 year olds, with the parents consent as they law sits now. It's a little creepy, no doubt.

Come again?

So the law then needs to change, if the perv has got her pregnant

That is is bad as within Islam, where the rapist, is asked to marry the person they raped and impregnated

You may want to see the reality mate

Research shows the state has the third-highest rate of child marriages in the nation, according to the Arlington, Virginia-based Tahirih Justice Center, a women's advocacy organization seeking to end child marriages in the United States.

Texas is first and Florida is second in child marriages, said Jeanne L. Smoot, a lawyer with the center. However, Texas has since changed its law to limit marriages to adults and Florida is considering a similar change, she said.

Too often, such marriages involve "child brides," teenage girls pressured into marriage by an older man who has coerced them into sex, said Smoot.

In some cases, an underage girl becomes pregnant and is pushed into marriage by an older man — sometimes with the support of the girl's parents — to hide evidence of his sexual involvement with a girl too young to legally consent to sex, she said.

"Pregnancy can be a red flag that a girl has been raped," Smoot said.

While the public may assume most underage marriages are between two teenagers, that represents only about 7 percent of such cases in Kentucky, Pollard said. The rest are teenage girls marrying older men.

A study underway at the University of Louisville's Kent School of Social Work examined about 11,000 marriages in Kentucky between 2000 and 2015 involving at least one minor and found that age variances as great as a 13-year-old girl marrying a 33-year-old man and a 15-year-old girl marrying a 52-year-old man, Pollard said.

"Teens marrying teens is not the case," she said.

So its clearly being allowed in Kentucky

Like I said, I don't know the law in Kentucky, and I think any 15 year old knocked up by an adult, needs to be protected from that adult, not married to him. Again, I think a crime has been committed in these cases.

But the original story has nothing to do with this. It's about non pregnant 16 and 17 year olds needing more permission than simply their parents permission. The pregnant under 15's already need a judges permission.

The original story addresses 16 and 17 year olds that want to marry with only their parents permission. The law would require a judge to sign off on it too. Judges already sign off on pregnant 15 and unders getting married.

As it stands, minors in Kentucky can marry at 16 or 17 with a parent’s permission and teens under 16 can marry with a judge’s permission. The new bill would change this to 18 but allow 17-year-olds to marry if they got permission of a judge and the age difference between the spouses was less than four years.

OK, I missed that part in bold.

It will prevent weirdos from marrying kids.

Sure, I already stated I had am issue with the big age differences in some of these marriages. I also think two 16 year olds are probably too young too, but stopping them from getting married probably isn't going to stop them from acting like they are married if you know what I mean, especially if the parents don't care.

I like the idea of age differences to be considered in all consent laws. A 17 year old and a 15 year old is far different than a 30 year old and a 17 year old, yet the first could be a crime, while the second isn't anywhere that I know of.

Anyway, I think any kid under 17 should probably need some sort of judges approval to enter into any adult relationship.

Bravo and well done

So surely you back this law change?

Why did you just not read the article in the first place mate?

It would have saved time

You now state some interesting points and in my opinion 18 is the starting point people should be allowed to marry. The brain does not even fully develope until at least 25, but we have to show some sense here.

Sorry, I thought reading the article prior to commenting was against the rules here. tongue

I'll work on reading first, and commenting second. Wink
