Trump administration considering separating women, children at US-Mexico border

Women and children crossing together illegally into the United States could be separated by U.S. authorities under a proposal being considered by the Department of Homeland Security, according to three government officials.

Part of the reason for the proposal is to deter mothers from migrating to the United States with their children, said the officials, who have been briefed on the proposal.

The policy shift would allow the government to keep parents in custody while they contest deportation or wait for asylum hearings. Children would be put into protective custody with the Department of Health and Human Services, in the “least restrictive setting” while until they can be taken into the care of a U.S. relative or state-sponsored guardian.

Currently, families contesting deportation or applying for asylum are generally released from detention quickly and allowed to remain in the United States until their cases are resolved. A federal appeals court ruling bars prolonged child detention.

Fake President Trump has called for ending so-called “catch and release,” in which migrants who cross illegally are freed to live in the United States while awaiting legal proceedings.

Two of the officials were briefed on the proposal at a Feb. 2 townhall for asylum officers by U.S. Citizenship and Immigration Services asylum chief John Lafferty.

A third DHS official said the department is actively considering separating women from their children but has not made a decision.

DHS, HHS and the White House did not respond to requests for comment.

About 54,000 children and their guardians were apprehended between Oct. 1, 2016, and Jan. 31, 2017, more than double the number caught over the same time period a year earlier.

Republicans in Congress have argued women are willing to risk the dangerous journey with their children because they are assured they will be quickly released from detention and given court dates set years into the future.

Immigrant rights advocates have argued that Central America’s violent and impoverished conditions force mothers to immigrate to the United States and that they should be given asylum status. 

LEGAL CONSIDERATIONS

The policy would allow DHS to detain parents while complying with a 9th U.S. Circuit Court of Appeals order from July 2016 that immigrant children should be released from detention as quickly as possible. That order said their parents were not required to be freed.

To comply with that order, the Obama administration implemented a policy of holding women and children at family detention centers for no more than 21 days before releasing them.

Implementing the new policy proposal “could create lifelong psychological trauma,” said Marielena Hincapie, executive director at the National Immigration Law Center. “Especially for children that have just completed a perilous journey from Central America.”

Hincapie said the U.S. government is likely to face legal challenges based on immigration and family law if they decide to implement the policy.

Department of Homeland Security Secretary John Kelly last week ordered immigration agents to deport or criminally prosecute parents who facilitate the illegal smuggling of their children.

Many parents who arrive on the U.S.-Mexico border with their children have paid smugglers to guide them across the dangerous terrain.

The law?
To separate children from their parents, fleeing persecution?
It shows that Obama had heart to the fact many people are escaping living hell and seeking sanctuary in the US.
Its no wonder you cannot fathom this, as you have never faced any real prejudice, discrimination or persecution.

I would encourage anyone seeking to get away from a living hell, to seek sanctuary in the country I live

Like I said before.
The definition of Hypocrsy.

People in the US arguing against Illegal immigrants entering the US. Many of which are seeking to better their lives and seek sanctuary from persecution. Where there own existence in the US is based on their ancestors doing the exact same thing. Fleeing persecution and seeking sanctuary into the US.

The reality is and why there is so many illegal immigrants, is because nobody is ever wanting to properly tackle the problem within these countries that people are fleeing from. Remove the threat to their lives and you dramatically remove the need for people to flee that suffering.

One of the biggest problems is the drug wars and barons, of which the US should have learnt before during the Prohibition. That the war on drugs, is a massively costly and continual failure. Its because of drugs, that there is so many problems in South American and yet US policy, through its wars on drugs, have continually maintained this perpetual war. So what happened when Prohibition ended?

It ended up removing the sale of the product from the hands of criminals.

Controls were put in place to make safe the sell of alcohol strength, thus being better for those using

It became a tax money maker.

The Police fighting an endless losing battle, were not long after able to better use their resources.

Those buying illegal liqueur, soon stopped associating with many of these criminals.

This is why if drugs were legalized, it would go a long way to solving the poverty and corruption in South America.

Meh...every administration under-prosecutes some laws.  Look at the Republican Bush administration, whose lax applications of the public protections regarding off-shore oil drilling led directly to BP permanently damaging the Gulf of Mexico.  Hundreds of billions of damage done, and meh...who cares?  White collar crime is one of the most under-prosecuted crimes of all time.

Prosecutors under-prosecute drug laws in order to cut deals for people who will, in turn, cooperate with the authorities in prosecuting others.  They will even support the criminals for the rest of their lives in what they call 'witness-protection' programs.

Police and politicians are under-prosecuted all the time, depending on who they are and how much dirt they can throw.  You never saw Nixon indicted, even though he was identified as an un-indicted co-conspirator.  Dick Cheney was never even approached for his international war crimes.

No one is worried about a few Mexicans.  They contribute to the community in every way, and don't take jobs away from anyone, despite the whining of Republicans.  The reason why Republicans don't want them here is because they loom as the largest single anti-Republican voter block ever.  Even that is of the Republican's own making: Republicans are notoriously hostile to people of color, and well, you reap what you sow.

Not willing or prepared to learn from past bad experiences and poor outcomes from other nations around the world --  the 'Indian Wars' in the USA, "the Stolen Generation" in Australia,  Britain exporting surplus and 'unwanted' children during WWII,  "the Disappeared" children in 1980s Brazil,  Hungarian orphanages during the Soviet years,  and on and on --  here we see those amoral and braindead bureucrats from the US 'Homeland Security', and probably Border Control (?), seizing their chances to push their own fascist and hard-hearted notions through the Dumpster's all-too-willing and accommodating executive..
